1. Acceptance of Terms

These Terms of Use (“Terms”) govern your use of the VanityOS mobile application (“App”) operated by Elle Kaen Ventures LLC. (“Company,” “we,” “us,” or “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

  • The App is intended for users aged 13 and older.
  • If you are under the age of majority in your jurisdiction, you may only use the App with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.
  • If you are under the age of majority, your parent or legal guardian is responsible for your use of the App and any data you provide.
  • We do not knowingly collect personal data from children under 13. If such data is identified, it will be deleted.

3. Description of the App

VanityOS is an AI-powered skincare and lifestyle tracking application that provides:

  • Skin photo-based informational insights
  • Food scanning and general acne-related scoring
  • AI chat assistant (“V”) for general skincare guidance
  • Progress tracking and visualization
  • Personalized informational suggestions based on user inputs

4. Important Health Disclaimer

THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

All content, including AI-generated outputs, skin insights, and food-related scores:

  • Is provided for informational and educational purposes only
  • Does not diagnose, treat, cure, or prevent any condition
  • Should not replace professional medical advice

Additional clarifications:

  • The App is not intended for clinical or severe skin conditions
  • Results and insights may vary and are not guaranteed
  • AI outputs may contain inaccuracies and should not be relied upon for health-related decisions
  • Always consult a qualified healthcare provider for medical concerns

5. Artificial Intelligence Disclosure

The App uses artificial intelligence technologies, including third-party providers, to generate outputs. This includes:

  • AI chat responses
  • Skin image analysis
  • Food recognition and scoring

You acknowledge that:

  • AI outputs are automated and not reviewed by medical professionals
  • Outputs may be incomplete, inaccurate, or not personalized
  • AI should not be relied upon as the sole basis for decisions

Third-Party Processing

User inputs (including text, images, and scans) may be securely transmitted to third-party AI providers (such as OpenAI) strictly for processing and feature functionality.

6. Data Collection and Use

We collect and process the following categories of data:

  • Personal information (e.g., name, birth date)
  • Sensitive data (e.g., skin condition data, facial images, and demographic data such as gender identity and ethnicity)
  • Food logs and usage activity
  • AI chat inputs and outputs
  • Device identifiers and authentication data

Sensitive Data Use

Sensitive data (including images and skin-related data) is collected and processed solely to provide core App functionality, including generating personalized insights, enabling AI-powered features, and tracking user progress.

We do not sell your personal data.

Data Retention

We retain personal data only for as long as necessary to provide the App's functionality and comply with legal obligations. When no longer required, data is deleted or anonymized.

User Consent

By using the App, you consent to the collection and processing of your data as described in these Terms and our Privacy Policy.

7. Photos and Image Processing

When you upload or capture photos:

  • Images may be processed on secure servers for analysis
  • Images may be stored locally on your device and/or securely in our systems where necessary to provide App features
  • Images are used solely for providing App functionality

We do not use your images for advertising purposes. We do not use your data to train AI models without your explicit consent.

8. Account Registration and Security

You may be required to create an account to access certain features. You agree to:

  • Provide accurate information
  • Maintain account security
  • Notify us of unauthorized access

We may suspend or terminate accounts that violate these Terms.

9. Account Deletion and Data Rights

You may delete your account and associated data at any time:

  • Directly within the App, or
  • By contacting us at: support@vanityos.app

Upon deletion, your data will be removed or anonymized in accordance with applicable laws.

10. Subscriptions and Payments

Free Trial

A free trial may be offered. If not cancelled at least 24 hours before the trial ends, it will convert into a paid subscription.

Subscription Plans

  • Monthly subscription
  • Annual subscription

The price, billing cycle, and subscription terms will be clearly displayed within the App before purchase.

Billing

  • Payment is charged to your App Store or Google Play account
  • Subscriptions automatically renew unless cancelled
  • Renewal occurs within 24 hours before the end of the billing period

Cancellation

Subscriptions can be managed and cancelled through your device settings:

  • iOS: Settings → Subscriptions
  • Android: Google Play → Subscriptions

Refunds

All refunds are handled by Apple or Google.

11. User Content

You retain ownership of any content you submit. By submitting content, you grant us a limited license to use it solely to operate and improve the App.

You agree not to upload content that is:

  • Illegal, harmful, or abusive
  • Infringing on intellectual property
  • Malicious or unrelated to App use

12. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which explains how your data is collected, used, and protected.

13. Intellectual Property

All App content, features, and technology are owned by Elle Kaen Ventures LLC. You are granted a limited, non-transferable license for personal use only.

You may not:

  • Copy or distribute the App
  • Reverse engineer the App
  • Use the App commercially without permission

14. Third-Party Services

The App integrates with third-party providers, including:

  • AI service providers
  • Payment platforms (Apple / Google)
  • Backend services

We are not responsible for third-party services or their policies.

15. Disclaimer of Warranties

The App is provided “as is” and “as available.” We do not guarantee:

  • Accuracy of content or AI outputs
  • Uninterrupted service
  • Suitability for your specific needs

16. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Indirect or consequential damages
  • Health-related outcomes
  • Reliance on AI-generated content
  • Data loss or unauthorized access

Total liability is limited to the amount you paid in the past 12 months.

17. Indemnification

You agree to indemnify and hold harmless Elle Kaen Ventures LLC. from claims arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your submitted content

18. Termination

We may suspend or terminate access at any time. Upon termination:

  • Your right to use the App ends
  • Your data may be deleted

19. Changes to Terms

We may update these Terms at any time. We will notify users of material changes via:

  • In-app notice
  • Updated “Last Updated” date

20. Governing Law

These Terms are governed by the laws of Wyoming, USA. Disputes will be resolved through arbitration on an individual basis.

21. Apple-Specific Terms

  • This agreement is between you and Elle Kaen Ventures LLC., not Apple
  • Apple has no obligation to provide support
  • Apple is a third-party beneficiary of these Terms

22. Google Play Terms

  • This agreement is between you and Elle Kaen Ventures LLC., not Google
  • Google is not responsible for the App
